Conditions of Use

These Terms and Conditions apply to all orders placed through this website. Placing an order indicates your acceptance of these terms and conditions.

Availability of goods
All orders are subject to acceptance and availability. If the goods you have ordered are not available from stock or will not be readily available from suppliers within 7 working days we will contact you by e-mail or telephone (if you have given us the details). We will make every effort to obtain an estimated delivery date based on information provided from our suppliers. We will contact you with alternative suggestions and you will have the option either to wait until the item is available from stock, adjust your order to a suggested alternative, or to cancel your order.

Pricing
While we make every effort to ensure that the items shown on our website are available at the price shown, we cannot guarantee that this will always be the case. If the goods you have ordered online are unavailable at the stated price or conditions shown, you will be notified as soon as possible and you will be given the option of buying the goods at the correct price or cancelling the order.

Gift vouchers
You can purchase gift vouchers at Kairos Jewellery. Gift vouchers can be added to your shopping basket as a normal item and either be sent to you or the recipient as detailed in despatch. Gift vouchers are available in denominations of £10 - £50. Your gift recipient will be able to redeem them against any jewellery purchase online or in store.

Each voucher will have a unique voucher number. You can redeem the voucher against any jewellery purchase online by following the instructions given, or by bringing the voucher to our store. Vouchers can be used in part payment for items of a greater value, but not be refunded, in whole or in part, for cash.

Placing your order by telephone
If you would prefer to place your order by telephone, please contact our shop during opening hours: 9:30am to 4:30pm Monday to Friday; 9:30am to 4:00pm Saturday (British Standard Time). Our telephone number is 016977 42777; from overseas: ++44 16977 42777.

Despatch and delivery
We will normally despatch your order the same day, if the item is in stock and the order is placed before 1pm (Monday to Friday) and 10pm (Saturday). We will send you an e-mail confirming despatch as soon as your goods are despatched.

UK orders
We offer FREE POSTAGE on all UK orders, regardless of size. Orders under the value of £125 are posted via Royal Mail First Class post (with a certificate of posting obtained). Orders over the value of £125 are posted via Royal Mail Special Delivery, a signed for delivery service guaranteed to arrive the next working-day. Some places take longer to deliver to (remoter parts of the Channel Islands and Scotland), but delivery is still guaranteed within three working days. Royal Mail Special Delivery parcels will need to be signed for and it is your responsibility that the delivery address is an address where you, or someone acting on your behalf, will be present at the time of delivery. In the event that no one is present when your parcel is delivered, Royal Mail will leave a calling card detailing further options for delivery or collection. Overseas orders
We deliver to all European Community (EC) countries plus other non-EC countries to which the Royal Mail Airsure service is available (currently Andorra, Australia, Brazil, Canada, Canary Islands, Faroe Islands, Hong Kong, Iceland, Liechtenstein, Malaysia, New Zealand, Singapore, Switzerland, USA). Delivery generally takes from 2 to 6 working days depending on destination. Please visit the Royal Mail website for further information.

When ordering goods for delivery overseas, you may be subject to import duties and taxes which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country and we advise you should contact your local customs office for further information. Please note that any duty and taxes incurred in the country of destination are the responsibility of the customer.

Additionally, please note that when ordering from us, you are considered the importer and must comply with all laws and regulations of the country in which you are receiving the goods. We would like our international customers and customers despatching products internationally to be aware that cross border deliveries are subject to opening and inspection by customs authorities.

BFPO
We offer free postage to all BFPO addresses. Orders under the value of £125 are posted via Royal Mail First Class post (certificate of posting obtained). Orders over the value of £125 are posted via Royal Mail HM Forces Special Delivery.

Payment
Payment can be made by credit or debit card using either our secure online banking system, or by giving details by telephone.

Risk and Ownership
You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Cancellation Rights
To cancel an order (or part of an order) before despatch you can do so at any time before we have sent out our despatch e-mail to you. To do this, please e-mail us at sales@kairosjewellery.co.uk or by telephone (016977 42777; from overseas: ++44 16977 42777). To cancel the order you will need to give us your name and address details, as well as your order number. Once you have notified us that you are cancelling your order, any sum debited to us from your credit or debit card will be reaccredited to your account as soon as possible and, in any event, within 30 days.

Under the Distance Selling Regulations you have the legal right to cancel your order within 7 days of receipt of your goods (with the exception of any made to order items). You do not need to give us any reason for cancelling your contract, although any information offered will help improve our service, nor will you have to pay any penalty. However, you will need to notify us if you wish to cancel your contract by e-mail to sales@kairosjewellery.co.uk or by post.

If you have received the goods, then you must send the goods back to our address at your own cost and risk. We recommend that you return the goods by either Royal Mail Recorded 1st Class or Royal Mail Special Delivery. When returning goods please include your full name and address along with the original order number.

Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be reaccredited to your account as soon as possible and, in any event, within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition that they were in when they were delivered to you. If you do not return the goods delivered to you, or do not pay the costs of delivery, we will be entitled to deduct the direct cost of recovering the goods from the amount to be reaccredited to you. Any customs duties and sales taxes levied on shipments outside of the European Community are non-refundable.

Please note that these rights do not extend to bespoke orders. Also, please note that for health and hygiene reasons these rights do not extend to pierced jewellery (earrings).

Bespoke orders
A bespoke order is any item of jewellery that is created by us, or any of our suppliers on our behalf, in accordance with your specifications (for example: specially sized rings or engravements). Once the request of a bespoke order has been verified, we will send you a confirmation e-mail with an estimated delivery time. We will request that you reply to us via e-mail to acknowledge and confirm that you accept the terms of the special order. The order will then be processed as soon as we receive payment. [This can be made in full or by means of a 50% non-refundable deposit. The remaining payment can then be completed when we receive your item from the manufacturer prior to despatch.]

The item will be a special order, which means it will have been made specifically for you as it is not an item held generally in stock. Due to this, such items cannot be exchanged or returned unless by prior agreement. Once we have received confirmation that you accept the terms of the special order you will not be able to cancel your order.

Damaged or faulty goods
We check every item of jewellery prior to its despatch but should you find the jewellery to be faulty or damaged in any way on receipt then we will exchange it. Please inform us within 7 days of receipt of the goods of any faults by e-mail to sales@kairosjewellery.co.uk. Please ensure that you return the goods by either Royal Mail Royal Mail First Class post (with a certificate of posting obtained) for items under the value of £125 or Royal Mail Special Delivery for items over the value of £125. When returning goods please include your full name and address along with the original order number.

You will be reaccredited for the costs incurred in returning faulty or unsatisfactory goods.

Cancellation by us
We reserve the right to cancel the contract between us if:
1. We have insufficient stock to deliver the goods you have ordered, or
2. We do not deliver to your area; or
3. One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our supplier.

If we do cancel your contract we will notify you by email and will reaccredit your account any sum deducted by us from your credit or debit card as soon as possible but, in any event, within 30 days of your order.

Our liability
Whilst we make every effort to ensure our website is as accurate as possible, we are not liable for any inaccuracies or errors which are beyond our reasonable control. Please be aware that colours and images can vary slightly according to the monitor that they are viewed on. Product dimensions supplied are intended to give an approximate indication of the size of individual products. Products shown may not be actual size. There may be variations in size and colour of hand-made products.

If you do not receive goods ordered by you within 30 days of the date on which you ordered them we will have no liability to you unless you notify us by e-mail or in writing of the problem within 60 days of the date on which you ordered the goods (unless this is not reasonably practicable). If you notify us under this condition our only obligation will be:
1. To make good any shortage or non delivery, or
2. To replace or repair any goods that are damaged or defective; or
3. To refund to you the amount paid by you for the goods in question.

Children
We do not sell products online for purchase by children. Some of our products may be suitable for children but must be purchased by an adult.

Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

We reserve the right to change these terms and conditions at any time. Any changes will take effect from when they are posted on this website.
